What Is Kansas Form K-40?

Kansas Form K-40 is used by full-year residents to file their state income tax return. The purpose of Form K-40 is to calculate how much Kansas income tax you owe or if you are due a refund. Part-year and nonresident filers must file Kansas Form K-40NR instead of K-40. Kansas does not currently offer a short form for individuals. Read the Which Form to File section of the 2024 Kansas Form K-40 instructions to determine whether you should file K-40 or K-40NR.

Who Must File Kansas Form K-40?

If you are a full-year Kansas resident and are required to file a federal income tax return, you generally must file Form K-40. You may also need to file if your gross income exceeds your Kansas standard deduction plus exemption allowance. For 2024, single filers under age 65 must file if their gross income is $12,765 or more. Married filers under age 65 must file if their gross income is $26,560 or more. Gross income generally means all income before deductions other than income specifically exempt from state taxes.

You may still benefit from filing if your income is below the required threshold. You could receive a refund of state tax withheld on your W-2, for example. Kansas also offers various tax credits, such as the Kansas Earned Income Tax Credit (Kansas EITC), which is based on your federal EITC. Review the credits section in the 2024 Kansas K-40 instructions to see if you qualify for the Kansas EITC or other state credits.
